Can You File in New York?
One of the first questions I ask my clients is how long they have lived in New York. New York is a major metropolitan area that attracts people from all over the country, probably more so than any other city in the US. With that being said, just because you’ve been here for a month or two doesn’t necessarily mean you can file in New Yokr. In general, though, I am able to help most of my clients who want to file in New York the ability to file – although it may take a month or two. Here is why…
In order to file bankruptcy in a particular state the bankruptcy petition must be filed in the proper venue i..e in the right state and district. In order to accomplish that the bankruptcy must be filed in the state where you have lived for the greater of 180 days. So if you’ve been in New York for 3 months and 1 days then you can file in New York.
