			<content:encoded><![CDATA[<p>I just wanted to write about an all too common problem so many of my clients face &#8211; indecision.  For many, they are way behind on credit card payments and possibly their home and car payments.  They know they should file bankruptcy because that is the only real way that they can wipe out there massive amounts of debt &#8211; but for whatever reason they resist.  <span id="more-113"></span></p>
<p>Unfortunately, for many people they will wait until the problems are just so large that there is nothing left to do but file.  They will inevitably call me moments after their car is repossessed or their house is officially put up for foreclosure.  All of this could have been avoided in bankruptcy if they would have only gotten over their indecision.</p>
<p>I realize that for many of my clients this is a very trying time.  You don&#8217;t have much money and the bills are only getting larger.  I urge you to DO something.  Reach out to a bankruptcy lawyer &#8211; but do something.  Simply waiting for all of this to somehow magically pass is not being realistic.  You must address the problems you are facing head on.</p>

			<content:encoded><![CDATA[<p>One of the first questions I ask my clients is how long they have lived in New York.  New York is a major metropolitan area that attracts people from all over the country, probably more so than any other city in the US.<span id="more-93"></span><!--more--> With that being said, just because you&#8217;ve been here for a month or two doesn&#8217;t necessarily mean you can file in New Yokr.  In general, though, I am able to help most of my clients who want to file in New York the ability to file &#8211; although it may take a month or two.   Here is why&#8230;</p>
<p>In order to file bankruptcy in a particular state the bankruptcy petition must be filed in the proper venue i..e in the right state and district.  In order to accomplish that the bankruptcy must be filed in the state where you have lived for the greater of 180 days.  So if you&#8217;ve been in New York for 3 months and 1 days then  you can file in New York.</p>
